§ 1

Preliminary provisions

  1. The Online Store www.precisiontec.eu is operated by P.H.U. Krzysztof Pogłodziński, ul. Kopanina 28/32 B103, 60-105 Poznań, Poland, Tax Identification Number (NIP): 7891676813, National Business Registry Number (REGON): 302150102, email address: biuro@precisiontec.eu

  2. These Terms and Conditions are addressed to both Consumers and Entrepreneurs using the Store. They define the rules for using the Online Store and the rules and procedure for concluding Sales Agreements with Customers remotely via the Store.

  3. Sales Agreement shall be governed by, and construed in accordance with, the laws of the Poland.

§ 2

Definitions

  1. Consumer – a natural person performing a legal act with the Seller not directly related to their business or professional activity, in particular who places an order in the Store.

  2. Seller – P.H.U. Krzysztof Pogłodziński”, ul. Kopanina 28/32 B103, 60-105 Poznań, Tax Identification Number (NIP): 7891676813, National Business Registry Number (REGON): 302150102.

  3. Customer – any entity making purchases through the Store.

  1. Entrepreneur – a natural person, a legal person and an organizational unit that is not a legal person, to which a separate act grants legal capacity, conducting business activity on its own behalf, which uses the Store.

  2. Online Store – online store run by the Seller at the Internet address https://precisiontec.eu

  3. Distance contract – a contract concluded with the Customer as part of an organised system of concluding distance contracts (within the Store), without the simultaneous physical presence of the parties, with the exclusive use of one or more means of distance communication up to and including the moment of conclusion of the contract.

  4. Regulations – these regulations of the Store.

  5. Order – a declaration of intent of the Customer submitted via the Order Form and aiming directly at concluding a Product Sales Agreement or Products with the Seller.

  6. Order Form – an interactive form available in the Store enabling the placement of an Order, in particular by adding Products to the Cart and specifying the terms of the Sales Agreement, including the method of delivery and payment.

  7. Shopping Cart – an element of the Store software in which the Products selected by the Customer for purchase are visible, and it is also possible to determine and modify the Order data, in particular the quantity of products.

  8. Product – a tangible item/service available in the Store that is the subject of the Sales Agreement between the Customer and the Seller.

  9. Sales Agreement – a Product sales agreement concluded between the Customer and the Seller via the Online Store.

§ 4

Technical requirements

  1. To use the Store, including browsing the Store's assortment and placing orders for Products, you must have:

    a. device with internet access and a web browser such as Internet Explorer, Edge, Safari, Chrome, or Firefox, or any other browser that meets applicable network security standards (encryption standards) and complies with web programming language standards (including HTML, CSS3, and JavaScript),

    b. an active email account,

    c. cookies enabled.

§ 5

General information

  1. To the fullest extent permitted by law, the Seller shall not be liable for any disruptions, including interruptions in the operation of the Store, caused by force majeure, unauthorized actions of third parties, or incompatibility of the Online Store with the Customer's technical infrastructure.

  2. Browsing the Store's assortment does not require creating an Account. Customers can place orders for Products from the Store's assortment by providing the necessary personal and address information, enabling Order fulfillment without creating an Account.

  3. Prices listed in the Store are displayed depending on the currency selected at the top of the page – in Polish zloty/euro/US dollars – and are gross prices (inclusive of VAT at the rate specified by tax regulations).

  1. The final amount payable by the Customer consists of the Product price and the shipping cost (including transportation, delivery, and postal fees), which the Customer is informed about on the Store's website when placing the Order, including when expressing their intention to enter into a Sales Agreement.

§ 6

Ordering Procedure

To place an Order, you must:

  1. Select the Product to be ordered, and then click the "Add to Cart" button (or equivalent);

  1. Complete the Order Form by entering the recipient's details, enter the invoice details if different from the recipient's details, optionally complete the discount coupon field, and accept the required consents: to the Terms and Conditions, Privacy Policy;

  1. Click the "Buy and Pay" button;

  1. Select one of the available payment methods and, depending on the payment method, pay for the order within the specified timeframe.

§ 7

Available Delivery and Payment Methods

  1. The Customer may use the following delivery or collection methods for the ordered Product:

    a. InPost parcel locker

    b. DHL courier

  2. The Customer may use the following payment methods:

    a. Electronic payments and card payments via paynow.pl – the current payment methods available are specified on the website http://www.paynow.pl. Electronic payment and card transactions are settled according to the Participant's selection via paynow.pl. Electronic payments and card payments are processed by: paynow.pl – a company of mElements S.A. with its registered office in Warsaw (address: ul. Prosta 18, 00-850 Warsaw, Poland), entered into the Register of Entrepreneurs of the National Court Register under number 0000590484, registration files maintained by the District Court for the Capital City of Warsaw in Warsaw, share capital of PLN 19,700,000.00, fully paid up, Tax Identification Number (NIP): 5223047892.

  3. Detailed information on delivery methods and acceptable payment methods can be found on the Store's website.

§ 8

Performance of the Sales Agreement

  1. The Sales Agreement between the Customer and the Seller is concluded after the Customer places an Order using the Order Form in the Online Store in accordance with § 6 of the Terms and Conditions.

  2. After placing the Order, the Seller immediately confirms its receipt and simultaneously accepts the Order for processing. Confirmation of receipt of the Order and its acceptance for processing occurs by the Seller sending the Customer an appropriate email to the Customer's email address provided during the Order placement process. The email message contains at least the Seller's statement of receipt of the Order and its acceptance for processing, as well as confirmation of the conclusion of the Sales Agreement. Upon receipt of the above email by the Customer, the Sales Agreement between the Customer and the Seller is concluded.

  3. The Customer is obligated to make payment within 7 calendar days from the date of conclusion of the Sales Agreement; otherwise, the order will be canceled.

§ 9

Right of Withdrawal, Returns

  1. The Consumer may withdraw from the contract for the sale of Goods purchased in the Store, without giving any reason, by submitting a relevant written declaration within fourteen (14) days from the date of delivery of the Goods (i.e., from the date of receipt of the Goods by the Consumer). To comply with this deadline, the Consumer must send the declaration before its expiry.

  2. The Consumer may withdraw from the contract by submitting a declaration of withdrawal to the Seller. A template for the declaration is attached as Appendix 1 to these Terms and Conditions.

  3. The declaration of withdrawal from the contract should be sent to the Seller's address provided in § 3 or electronically to: biuro@precisiontec.eu

  4. The Consumer will return the Goods to the Seller within fourteen (14) days from the date on which they withdrew from the contract. To meet this deadline, it is sufficient to return the Goods before its expiry.

  5. The Goods should be returned to the Seller's address provided in § 3.

  6. The Seller will, within fourteen (14) days of receiving the declaration of withdrawal from the contract, refund all payments made by the Consumer, including the cost of shipping the Goods to the Consumer. However, the refund will not be made until the Goods are received back.

  7. The Seller will refund the payment using the same payment method used by the Consumer.

  8. The Consumer will bear the costs of returning the Goods to the Seller.

§ 10

Complaints and Warranty

  1. The Sales Agreement covers new Products.

  2. If a defect occurs in goods purchased from the Seller, the Customer has the right to file a complaint based on the warranty provisions of the Civil Code. If the Customer is an Entrepreneur, the parties exclude liability under the warranty.

  3. Complaints should be submitted in writing to the Seller's address provided in § 3 or electronically to: biuro@precisiontec.eu

  4. The Seller will respond to the complaint immediately, and if the Customer is a Consumer, no later than within 14 days. If the Customer is a Consumer and the Seller does not respond to the complaint within 14 days, the Customer's request is deemed to have been deemed justified.

  5. Goods returned under the complaint procedure should be sent to the address provided in § 3 of these Terms and Conditions.

§ 11

Out-of-court methods of dealing with complaints and pursuing claims

  1. The Seller informs that after the end of the process of considering the complaint, the complainant is entitled to use extrajudicial means of dealing with complaints and pursuing claims. For this purpose, the complainant may, in particular, use one of the alternative methods of resolving domestic and cross-border consumer disputes (alternative dispute resolution, ADR), including mediation, arbitration, conciliation, or use the online dispute resolution platform (ODR).

  2. Detailed information on extrajudicial dispute resolution and redress procedures as well as rules of access to these procedures are available at the registered office, as well as on the website of the European Consumer Centre (clearing house) operating in the complainant's country. The European Consumer Centre (clearing house) will help the complainant to forward a cross-border complaint to the relevant ADR system in the Seller’s country.

  3. The complainant may also use the online dispute resolution (ODR) platform – the platform is the access point for consumers and entrepreneurs seeking out of court dispute resolution. It is an interactive website offering electronic and free of charge access in all official EU languages, available at http://ec.europa.eu/consumers/odr/.

  4. The use of any extrajudicial methods of dealing with complaints and redress is voluntary and can take place with the consent of all of the parties. 

§ 12

Personal Data in the Online Store

  1. The Controller of Customers' personal data collected via the Online Store is Krzysztof Pogłodziński, conducting business under the name "P.H.U. Krzysztof Pogłodziński", ul. Kopanina 28/32B 103, 60-105 Poznań, Poland, Tax Identification Number (NIP): 7891676813, National Business Registry Number (REGON): 302150102. (Seller).

  2. For any matters related to personal data protection, please contact the Seller by email: biuro@precisiontec.eu.

  3. The Participant consents to the processing of personal data in accordance with Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC.

  4. Customer personal data collected by the Administrator via the Online Store are collected for the purpose of fulfilling the Sales Agreement, to fulfill the Administrator's obligations related to recording business transactions and taxes pursuant to Article 6(1)(c) of the GDPR in connection with tax law, for marketing purposes, and to maintain contact with the Customer.

  5. The categories of data processed by the Organizer include: first name, last name, mailing address with postal code and city, email address, contact telephone number (optional), and, in the case of invoice issuance: company name, company address with postal code, city, and Tax Identification Number (NIP).

  6. The recipients of Customer personal data of the Online Store may be:

    a. In the case of a Customer who uses electronic payments or a payment card in the Online Store, the Administrator shares the collected Customer personal data with the selected entity handling these payments in the Online Store.

    b. Entities and bodies to which the Controller is obligated to disclose personal data under applicable law, as well as entities providing accounting services to the Controller.

  7. Data will be processed for the time necessary to fulfill the purpose for which it was collected.

  8. The Customer has the right to access and correct their data.

  9. Providing personal data is voluntary, although failure to provide the personal data required for the conclusion of the Sales Agreement specified in the Terms and Conditions will result in the inability to conclude the Agreement.

  1. The Customer has the right to file a complaint with the supervisory authority.

§ 13

Final Provisions

  1. The Seller reserves the right to amend the Terms and Conditions for important reasons, including: changes in legal regulations, changes in payment and delivery methods – to the extent such changes affect the implementation of the provisions of these Terms and Conditions. The Seller will inform the Customer of any changes at least 7 days in advance.

  2. The Seller reserves the right to introduce and withdraw offers, promotional campaigns, and to change prices in the Store without prejudice to the rights acquired by the Buyer, including, in particular, the terms of Contracts concluded before the amendment.

  3. In matters not regulated by these Terms and Conditions, the generally applicable provisions of European Union law shall apply, in particular: the Civil Code; the Digital Service Act; the Consumer Rights Directive; and the General Data Protection Regulation.

  4. The Customer has the right to use out-of-court complaint and redress procedures. To this end, you can submit a complaint via the EU ODR online platform, available at: http://ec.europa.eu/consumers/odr/

These Regulations are effective from July 15, 2025.
